• Why did I receive the Notice of Chapter 11 Bankruptcy Cases?
  You are a potential creditor in the bankruptcy case of ASARCO LLC or one of its debtor subsidiaries.

• When and Where did ASARCO LLC file for bankruptcy?
  ASARCO LLC f/k/a ASARCO Incorporated or ASARCO Inc. filed on August 9, 2005, in the U.S Bankruptcy Court for the Southern District of Texas (Corpus Christi Division). However, many other subsidiaries of ASARCO LLC also have filed and all of their bankruptcy cases are being jointly administered under the main Bankruptcy Case No. 05-21207.

• What is ASARCO LLC?
  ASARCO LLC is an integrated copper-mining, smelting, and refining company. ASARCO is one of the leading producers of copper and one of the largest non-ferrous metal producers in the United States.

• What is the Trumbull Group?
  It is the official claims agent appointed by the U.S. Bankruptcy Court for the Southern District of Texas. We assist in giving notice to creditors and manage the proofs of claim.

• If a claim was previously filed with the court do we need to file another claim?
  No, unless you assert an asbestos-related claim against ASARCO LLC or any of its subsidiaries that are also debtors in this Chapter 11 case. If your claim is related to asbestos and you did not use the Asbestos-Related Proof of Claim Form, then you need to re-file your claim. For more information, please refer to the Asbestos Bar Date Notice located under the heading “Proofs of Claim and Bar Date Documents.”

• Will I receive a proof of claim?
  You should have already received a Bar Date Notice with a corresponding proof of claim form. If you have not, please contact Trumbull at the number below. Also, make sure to tell the representative if your claim is related to asbestos because there is a separate set of instructions and a special form for Asbestos-Related Claims.

• How do I fill out the Proof of Claim form?
  Please refer to the instructions contained in the applicable Bar Date Notice. You should have received a set of instructions in the mail with the proof of claim form. Additionally, you can see a copy of the Bar Date Notices on this website, under the heading “Proofs of Claim and Bar Date Documents.”

• When will I receive my money?
  Some time after the Asbestos Bar Date, the Debtors will file a proposed Plan of Reorganization. The creditors will vote on a Plan of Reorganization. If the plan is confirmed by the Bankruptcy Court and your claim becomes an allowed claim (or authorized), then the timing of the payments and the amounts to be paid will be determined by the Plan.
  (This is a lengthy process and it could take several months; in addition, you may not receive 100% of your claim).

• If I have claims against a number of the individual Debtors, may I file all claims on one form?
  No. Claims against each Debtor must be filed on separate Proof of Claim forms.

  No.

• Does this affect my pensions and 401K?
  As of what we know now, this does not affect your pensions or 401K. If you would like to fill out a proof of claim form to protect your interest, you may do that.
